1. Definitions
Customer(s): any individual or legal entity wishing to benefit from the services provided by ThimPress.
Personal Data: Personal data as defined by European regulations and, in particular, in France by the Data Protection Act (“loi informatique et libertés”) of January 6, 1978, as amended, which is entered, disclosed or communicated by the Customer while using Products or Services of ThimPress.
Plugin: WordPress Plugins developed by ThimPress.
Theme: WordPress Themes developed by ThimPress.
Products: WordPress Plugins and WordPress Themes developed by ThimPress.
Service: Support, Updates and Customizations.
Support: The support, assistance and/or maintenance services provided by ThimPress, including support, maintenance and upgrading services under the License, on the condition that such modifications or upgrades would not require rewriting of a substantial part of the existing Plugin or Theme.
Technical Requirements: The latest version of the list of Plugins and Themes recommended by ThimPress and appropriate for the use must implement and maintain in compliance. The Customer shall be responsible for managing their use and for upgrading their hardware and systems in accordance with changes made to the Technical Requirements.
Update: The improvements and changes made to Plugins and Themes by ThimPress, in terms of feature upgrades and on the condition that such modifications or upgrades do not require rewriting of a substantial part of the existing standard Products. Updates are provided as part of the Support service.

2. Price and Payment
2.1 Price
2.1.1 Pricing
The prices and technical specifications of the Products and Services offered by ThimPress may be viewed at www.thimpress.com.
Prices are shown in USD.
ThimPress reserves the right to revise its pricing at any time.
2.1.2 Promotional code
The Customer may use a promotional code to be entered when the order is placed on www.thimpress.com. NB: only one promotional code is allowed per order.
2.2 Payment
Products remain the property of ThimPress until full payment is received.
Customers may pay by PayPal; a payment system is used worldwide.
The Customer agrees to receive only digital invoices.
3. Privacy
The private information required for executing the orders placed through https://thimpress.com, namely the Customer’s personal information and credit card details, address and telephone numbers will be kept in the strictest confidence by ThimPress and not sold or made known to third parties.
Credit card details are not kept by ThimPress under any circumstances.
ThimPress may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Customer.
4. License Policy
After the payment is completed, customers get a license for each purchased product from ThimPress. With this license, customers have 12 months to download product file, get product update and receive support.
When license time expire, customers will receive notification and the option to renew for a longer time.
Important note: each license only can be used for 1 domain.
5. Refund Policy
The default refund period is 30 days from the transaction date due to the PayPal Refund Policy.

In order to request a refund, the Customer must follow the ThimPress Refund Rules.

6. Updating of these Terms & Conditions
ThimPress reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to https://thimpress.com. It is the Customer’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The Customer’s continued use of https://thimpress.com following the posting of changes or updates will be considered notice of the Customer’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
7. Cookies
Information on the Customer’s browsing on https://thimpress.com is stored by cookies.
Pursuant to applicable regulations, this information may be stored for a period of up to 13 months.
Cookies do not allow the Customer to be identified.
The Customer may oppose the recording of cookies and disable them in its web browser settings, on the understanding that this may restrict their use.
8. Copyright and Intellectual Property Rights
ThimPress provides certain information at https://thimpress.com. Content currently or anticipated to be displayed at https://thimpress.com provided by ThimPress, its affiliates and/or subsidiary, or any other third-party owners of such content, and includes but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematograph Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions and Computer Programs (“the Content”). All such proprietary works, and the compilation of the proprietary works, are copyright the ThimPress, its affiliates or subsidiary, or any other third-party owner of such rights (“the Owners”), and is protected by United of Kingdom and international copyright laws. ThimPress reserves the right to make any changes to the Content, or to Products and/or Services offered through https://thimpress.com at any times and without notice. All rights in and to the Content is reserved and retained by the Owners. Except as specified in these Terms and Conditions, the Customer is not granted a license or any other right including without limitation under Copyright, Trademark, Patent or other Intellectual Property Rights in or to the Content.
With the products are developed by ThimPress, which are being sold both on ThimPress website and Envato Market. This includes the WordPress Themes, WordPress Plugins, WordPress Add-ons and design of these products. We own the all the licenses, trademarks, logos and trade names. You are not allowed to copy, distribute, modify or make derivative works of any of our ThimPress products or use any of our intellectual property in any way not expressly stated in these terms.
9. Limitation of liability
The Website and all Content on the Website, including any current or future offer of Products or Services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy or completeness of the Content. Neither Provider nor any holding company, affiliate or subsidiary of ThimPress, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if ThimPress is expressly advised thereof.
10. Choice of Law
ThimPress is controlled, operated and administered by BIZFLYGROUP LTD from its offices at the 12 Constance Street, London, England, E16 2DQ. Access to ThimPress from territories or countries where the contents or purchase of the Products and Services sold on https://thimpress.com is illegal is prohibited. If the Customer accesses ThimPress from locations outside of United of Kingdom, that Customer is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the United of Kingdom, and the Customer consents to the jurisdiction of the Witwatersrand High Court in the event of any dispute. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between ThimPress and the Customer with regard to the use of the Products and Services of ThimPress.
11. Personal Data
Personal Data means data provided by the Customer while using Products and Services of ThimPress at https://thimpress.com.
Personal Data collected via ThimPress is hosted by BIZFLYGROUP LTD, 12 Constance Street, London, England, E16 2DQ.
11.1 Purpose of processing
The Data provided when a Customer logs in or purchases Products are processed for the following purposes:
- Access to Products;
- Preparation of invoices;
- Circulation of newsletter, if applicable;
- Improvement of marketing and promotion initiatives, as well as Website content and offers;
- Receipt of customized offers.
11.2 Recipients of Personal Data
ThimPress agrees to take all useful precautions and implement all appropriate organizational and technical measures to maintain the security, integrity and confidentiality of Personal Data and, in particular, to prevent such data from being altered, damaged or accessed by unauthorized third parties.
11.3 Personal Data provided to government agencies and bodies
Pursuant to applicable regulations, Personal Data may be provided to the relevant authorities on request, including government bodies, solely in order to comply with legal obligations, court officers, ministerial officials and debt collection agencies.

ThimPress agrees not to sell or transfer Personal Data that has been collected to third parties, except as provided for by clause 10.3 hereof.
11.5 Customer’s right to oppose, correct and delete Personal Data
Customers have the right to access, challenge, modify, correct and delete their Personal Data.
Customers also have the right to oppose the processing of their Personal Data, provided they have legitimate reasons to do so, as well as the right to oppose the use of such data for the purposes of sales prospecting.
This assurance does not apply to processing for statistical purposes where the data is processed globally and anonymously.
